BackRow Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BackRow mobile application, website, and related services (collectively, the "Platform") operated by BackRow LLC, an Indiana limited liability company ("BackRow," "we," "our," or "us").
By creating an account, accessing, or using the Platform, you agree to these Terms and our Privacy Policy and Community Guidelines.
If you do not agree to these Terms, do not use BackRow.
1. Eligibility
You must be at least 16 years old to create an account or use BackRow.
By using BackRow, you represent that:
You are at least 16 years old;
You have the legal capacity to agree to these Terms, or otherwise have any consent required by applicable law;
The information you provide to us is accurate and not intentionally misleading; and
Your use of BackRow will comply with these Terms and applicable law.
If we learn that an individual under 16 has created an account, we may suspend or delete the account.
2. Student Accounts and University Affiliation
Student accounts generally require an eligible .edu email address.
You may also be required to select or identify your university or educational institution.
The .edu requirement is intended to help establish or verify affiliation with an educational institution. It does not mean that BackRow has independently verified every user's identity, enrollment status, course enrollment, or other information.
You may not use an email address or university affiliation that you are not authorized to use.
The .edu email requirement may not apply to authorized advertisers, recruiters, business partners, moderators, administrators, or other accounts approved by BackRow.
3. BackRow Is Independent From Universities
Unless expressly stated otherwise, BackRow is an independent platform and is not affiliated with, sponsored by, endorsed by, or operated by any university, college, professor, instructor, academic department, or educational institution.
References to universities, courses, instructors, departments, or other educational entities are provided for identification, organization, and discussion purposes.
The presence of a university or course on BackRow does not indicate that the university or its personnel participate in or endorse the Platform.
4. Accounts and Account Security
You are responsible for maintaining the security of your account and authentication credentials.
You agree to notify us if you become aware of unauthorized access to or use of your account.
You may not:
Access another person's account without authorization;
Sell, transfer, rent, or give your account to another person;
Create accounts for deceptive, fraudulent, abusive, or unlawful purposes;
Circumvent account suspensions, bans, or other enforcement actions; or
Use automated methods to create accounts without our authorization.
You are responsible for activity occurring through your account to the extent permitted by applicable law.
5. Usernames and Pseudonyms
BackRow permits users to select usernames that do not contain their real or legal names.
Your username may therefore be pseudonymous to other users.
However, your account is not necessarily anonymous to BackRow. BackRow may maintain an internal association between your username, registered email address, university, account information, and activity.
You may not select a username that:
Impersonates another person or organization;
Falsely suggests an official role or affiliation;
Violates another person's trademark or other legal rights;
Contains prohibited or abusive material; or
Is otherwise used to deceive, harass, defraud, or harm others.
BackRow may require a username to be changed or may remove or restrict a username when reasonably necessary.
6. User Content
BackRow allows users to create, upload, submit, send, or otherwise make available content, which may include posts, comments, messages, attachments, profile information, and other materials ("User Content").
You retain ownership of User Content you create, subject to the rights you grant to BackRow under these Terms.
You are responsible for your User Content and for ensuring that you have the right to submit it to BackRow.
You may not submit User Content that violates applicable law, these Terms, our Community Guidelines, intellectual property rights, privacy rights, or other rights of another person.
7. License You Grant to BackRow
When you submit User Content to BackRow, you grant BackRow a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, distribute, transmit, format, modify for technical purposes, and otherwise use that User Content as reasonably necessary to operate, provide, secure, moderate, promote, and improve the Platform.
This license allows us, for example, to:
Display your post to other users;
Store your content in our systems;
Deliver your messages to their intended recipients;
Format content for different devices;
Create technical copies and backups;
Moderate or review content;
Display public BackRow content in connection with promoting or demonstrating the Platform; and
Maintain Platform functionality.
This license does not transfer ownership of your User Content to BackRow.
The license ends when your User Content is deleted from our active systems, except to the extent that:
The content has been de-identified;
Copies remain temporarily in backups;
Retention is reasonably necessary for security, legal, moderation, or enforcement purposes; or
The content has been shared with others and remains as reasonably necessary to maintain Platform conversations or functionality, subject to applicable law.
8. Public Content and Profiles
Content you post in public or community areas of BackRow may be visible to other users.
Your username and university may also be visible to other users.
Depending on the Platform's features and your settings, other profile information may also be visible.
BackRow may allow you to hide certain posts from your profile. Hiding a post from your profile does not necessarily remove the post from the course, community, thread, feed, or other location where it was originally posted.
You should not post information publicly that you do not want other users to see.
9. Private Messages
BackRow may allow users to communicate through private messages.
Private messages are intended to be visible only to the participants in the conversation and are not displayed publicly.
However, BackRow may access, preserve, or review private messages when reasonably necessary to:
Investigate reports;
Prevent or investigate abuse, fraud, or security incidents;
Enforce these Terms or our Community Guidelines;
Protect BackRow, our users, or others; or
Comply with applicable law or valid legal process.
You may not use private messaging to harass, threaten, defraud, spam, exploit, or otherwise harm another person.
10. Prohibited Conduct
You may not use BackRow to:
Violate any applicable law or regulation;
Harass, threaten, bully, stalk, intimidate, or abuse another person;
Post hateful, discriminatory, or unlawfully threatening material;
Share another person's sensitive or private information without authorization;
Impersonate another person, professor, university employee, organization, or entity;
Defraud, deceive, scam, or exploit other users;
Distribute malware or malicious code;
Attempt to gain unauthorized access to accounts, systems, databases, or networks;
Interfere with or disrupt the operation or security of BackRow;
Circumvent security, moderation, rate limits, bans, or other Platform restrictions;
Scrape, harvest, extract, or collect information from BackRow through unauthorized automated means;
Use bots, scripts, crawlers, or similar automated systems without our written permission;
Spam users or manipulate Platform features;
Artificially manipulate votes, reputation, rankings, engagement, or other Platform metrics;
Use BackRow for unlawful commercial solicitation;
Infringe copyrights, trademarks, privacy rights, publicity rights, or other legal rights;
Upload or distribute content you do not have the right to share; or
Encourage, facilitate, or assist others in violating these Terms.
Additional rules regarding acceptable content and conduct may be contained in our Community Guidelines.
11. Academic Content and Academic Integrity
BackRow is intended to facilitate student discussion, communication, and exchange of information.
BackRow does not authorize users to violate university academic-integrity policies or applicable law.
You are responsible for understanding and complying with the rules of your university, course, professor, or academic program.
You may not use BackRow to unlawfully obtain, distribute, or sell restricted academic materials.
Depending on the circumstances, prohibited content may include:
Stolen or unauthorized examinations;
Exam questions obtained in violation of applicable rules;
Answer keys that you are not authorized to distribute;
Instructor-only materials;
Copyrighted textbooks or substantial portions of textbooks uploaded without authorization; or
Other materials whose distribution violates applicable law or the rights of another person.
BackRow does not guarantee that information shared by users complies with the academic policies of any particular educational institution.
12. Accuracy of User-Generated Information
BackRow contains information created by students and other users.
We do not guarantee that posts, comments, class reports, course information, recommendations, academic information, or other User Content is accurate, complete, current, or reliable.
You are responsible for independently verifying information before relying on it.
BackRow should not be treated as an official source of information from a university, professor, instructor, academic department, employer, recruiter, landlord, business, or other third party.
13. Reporting, Blocking, and Moderation
BackRow has zero tolerance for objectionable content and abusive users. BackRow provides tools that allow users to report content, report users, block users, or otherwise manage interactions.
We may investigate reported activity and take action that we consider appropriate under the circumstances.
Such actions may include:
Removing content;
Limiting content visibility;
Issuing warnings;
Restricting Platform features;
Suspending accounts;
Terminating accounts; or
Taking other reasonable measures.
BackRow is not obligated to host, display, distribute, or preserve any particular User Content.
We may remove or restrict User Content when we reasonably believe it violates these Terms, our Community Guidelines, applicable law, another person's rights, or presents a risk to the Platform or its users.
Moderation decisions necessarily involve judgment, and we do not guarantee that we will identify or remove every violation.
14. Intellectual Property
Except for User Content and third-party materials, BackRow and its associated software, designs, branding, logos, interfaces, features, graphics, databases, and other Platform materials are owned by or licensed to BackRow LLC and are protected by applicable intellectual property laws.
These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to access and use BackRow for its intended purposes.
You may not copy, reproduce, distribute, sell, license, reverse engineer, modify, or exploit BackRow's proprietary materials except as permitted by law or with our written permission.
15. Copyright Complaints
BackRow respects intellectual property rights.
If you believe content available through BackRow infringes your copyright, you may contact us at:

Your notice should identify the copyrighted work, the allegedly infringing material, information reasonably sufficient for us to locate the material, your contact information, and any other information required by applicable law.
We may remove or restrict access to content that we reasonably believe infringes intellectual property rights.
We may suspend or terminate accounts of users who repeatedly infringe the intellectual property rights of others where appropriate.
Include a statement that you have a good-faith belief the disputed use is not authorized by the rights holder, its agent, or law, a statement that your notice is accurate and, under penalty of perjury, that you are authorized to act for the rights holder, and your physical or electronic signature. We may request additional information and notify the affected user. This contact is not a representation that BackRow has registered a designated DMCA agent.
16. Advertising and Sponsored Content
BackRow may display advertisements, sponsored posts, recruiting opportunities, promoted content, or other commercial material.
Sponsored or commercial content may be targeted based on information described in our Privacy Policy, such as university, major, college year, course interests, or Platform activity. When BackRow uses third-party advertising services, their processing of advertising identifiers and related ad data is described in our Privacy Policy. On supported devices, you can manage App Tracking Transparency permissions and BackRow's advertising opt-out controls.
The appearance of an advertisement, recruiter, business, product, service, housing provider, or other third party on BackRow does not necessarily constitute BackRow's endorsement or recommendation of that party.
You are responsible for evaluating third-party offers before entering into transactions with them.
Advertisers and other commercial partners may be subject to additional terms with BackRow.
17. Recruiters and Employment Opportunities
BackRow may allow employers, recruiters, or other organizations to promote employment, internship, recruiting, or professional opportunities.
BackRow does not guarantee:
The legitimacy of every opportunity;
That a recruiter will contact or select you;
Employment or internship outcomes;
Compensation;
The accuracy of a job description; or
The conduct of a recruiter or employer.
Users should independently evaluate employment and recruiting opportunities before providing information or entering into agreements with third parties.
18. Third-Party Services and Links
BackRow may contain links to, integrations with, or content provided by third-party websites, businesses, services, or applications.
BackRow does not control third-party services and is not responsible for their content, availability, security, terms, or privacy practices.
Your interactions with third parties may be governed by separate terms and privacy policies.
19. Platform Changes and Availability
We may add, modify, suspend, discontinue, restrict, or remove Platform features at any time.
We do not guarantee that BackRow or any particular feature will always be available, uninterrupted, error-free, or supported.
We may perform maintenance, updates, security changes, or other modifications that temporarily affect availability.
20. Suspension and Termination
You may stop using BackRow at any time and may initiate account deletion through available account settings.
BackRow may suspend, restrict, or terminate your access to some or all of the Platform if we reasonably believe:
You violated these Terms or our Community Guidelines;
Your account presents a security or abuse risk;
Your activity may violate applicable law or another person's rights;
Suspension or termination is reasonably necessary to protect BackRow or others; or
Continued provision of the Platform to you is no longer reasonably practicable.
Where appropriate, we may provide warnings before taking action, but we are not required to do so in every circumstance.
Sections of these Terms that by their nature should survive termination will remain effective after termination, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and disputes.
21. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BACKROW AND THE PLATFORM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
BACKROW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW.
WE DO NOT WARRANT THAT:
THE PLATFORM WILL ALWAYS BE AVAILABLE, SECURE, OR ERROR-FREE;
USER CONTENT WILL BE ACCURATE OR RELIABLE;
CONTENT WILL NOT BE LOST;
EVERY VIOLATION WILL BE IDENTIFIED OR REMOVED; OR
USE OF THE PLATFORM WILL PRODUCE ANY PARTICULAR ACADEMIC, SOCIAL, EMPLOYMENT, FINANCIAL, OR OTHER RESULT.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
22. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BACKROW LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE PLATFORM.
THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, DAMAGES ARISING FROM:
USER CONTENT;
RELIANCE ON INFORMATION POSTED THROUGH BACKROW;
INTERACTIONS WITH OTHER USERS;
THIRD-PARTY PRODUCTS, SERVICES, ADVERTISEMENTS, OR OPPORTUNITIES;
LOSS OF DATA;
INTERRUPTION OF SERVICE; OR
UNAUTHORIZED ACCESS TO AN ACCOUNT OR INFORMATION.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BACKROW'S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
(A) THE AMOUNT YOU PAID DIRECTLY TO BACKROW DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
(B) $10.
The limitations in this section apply only to the extent permitted by applicable law.
23. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless BackRow LLC and its members, officers, employees, contractors, agents, and affiliates from claims, liabilities, damages, losses, and reasonable expenses, including attorneys' fees, arising out of or relating to:
Your User Content;
Your violation of these Terms;
Your violation of applicable law; or
Your infringement or violation of another person's rights.
This provision does not require you to indemnify BackRow for conduct for which indemnification cannot lawfully be required.
24. Privacy
Our collection, use, disclosure, and retention of personal information is described in our Privacy Policy.
By using BackRow, you acknowledge that you have had an opportunity to review the Privacy Policy.
25. Changes to These Terms
We may update these Terms from time to time as BackRow develops or as legal, regulatory, security, or operational requirements change.
When we update these Terms, we will update the "Last Updated" date.
If we make material changes, we may provide additional notice through the Platform, by email, or through another appropriate method.
If applicable law requires your consent to a change, we will obtain that consent as required.
Your continued use of BackRow after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
26. Governing Law
These Terms and any dispute arising out of or relating to these Terms or the Platform will be governed by the laws of the State of Indiana, without regard to conflict-of-laws principles, except where applicable law requires otherwise.
Nothing in these Terms limits any rights you may have under laws that cannot lawfully be waived.
27. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary, and the remaining provisions will remain in effect.
28. No Waiver
BackRow's failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.
29. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
BackRow may assign or transfer these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, or as otherwise permitted by law.
30. Entire Agreement
These Terms, together with the Privacy Policy, Community Guidelines, and any additional terms that expressly apply to a particular BackRow feature or service, constitute the agreement between you and BackRow regarding your use of the Platform.
If additional terms conflict with these Terms regarding a particular feature, the additional terms will control with respect to that feature to the extent of the conflict.

32. Mobile App Distribution
Your use of the mobile app must also comply with applicable Apple App Store or Google Play terms and usage rules. The store provider is not responsible for BackRow’s content, moderation, support, or privacy practices. Contact BackRow at backrowca@gmail.com for support. Any mandatory rights or applicable platform license terms remain in effect.
Our prohibition on child sexual abuse and exploitation applies to all users and content; see our Community Guidelines and public child-safety standards.
